Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the Arise & Shine mobile application and the ariseandshine.app website (together, the "Service"), operated by Arise & Shine ("we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility and age requirement

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. The App Store age rating for Arise & Shine is 4+; however, account creation and certain features require users to be 13 or older. By using the Service, you represent that you meet these requirements.

3. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices you own or control, for your own personal, non-commercial use. This license is also subject to Apple's App Store Terms of Service.

4. Freemium model and subscriptions

Arise & Shine is free to download and use with a core set of features ("Free"). We also offer an optional premium subscription ("Premium") that unlocks additional features such as extra themes, focus-mode backgrounds, and other enhancements.

• Pricing and the features included in each tier are shown in the app before you purchase and may change over time.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Premium is a personal entitlement and may not be shared or resold.

5. Subscription auto-renewal

Premium subscriptions are billed on a recurring basis (for example, monthly or annually, as selected at purchase).

• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the rate of your selected plan.
• You can manage or cancel your subscription, and turn off auto-renewal, in your device's Settings → Apple ID → Subscriptions at any time.
• Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

6. Refunds

All purchases are processed by Apple, and refunds are handled in accordance with Apple's policies. We do not directly process payments and therefore generally cannot issue refunds ourselves. To request a refund, visit reportaproblem.apple.com. Where required by applicable consumer law, you may have additional rights; nothing in these Terms limits those rights.

7. Your content (notes & reflections)

The Service may let you create personal content such as notes, reflections, and journal entries ("Your Content").

• You own Your Content. We do not claim ownership of it.
• You grant us a limited license to store and process Your Content solely to operate the Service for you (for example, to display and, where supported, sync it across your devices).
• You are responsible for Your Content and for keeping your own backups where important to you.
• You agree not to store unlawful content or content that infringes the rights of others.

8. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Copy, modify, reverse engineer, decompile, or attempt to extract the source code of the app, except as permitted by law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
• Resell, sublicense, or commercially exploit the Service without our written permission.

9. Intellectual property

The Bible verses displayed in the Service are drawn from public-domain translations and/or licensed sources; public-domain scripture is not owned by us. However, the Arise & Shine name, logo, design, themes, original text, graphics, software, and overall look and feel are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may not use our branding or copyrighted materials without our prior written permission.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that alarms will always sound, that the Service will be uninterrupted or error-free, or that it will meet your requirements. Do not rely on the Service as your sole alarm for safety-critical situations. Arise & Shine is intended for spiritual encouragement and is not a substitute for professional, medical, or pastoral advice.

11. Limitation of liability

To the maximum extent permitted by law, Arise & Shine and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, missed events, or missed wake-ups, arising out of or related to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us, if any, in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Termination

You may stop using the Service at any time and delete the app. We may suspend or terminate your access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

13. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the Province of Québec and the applicable laws of Canada, without regard to conflict-of-law principles. Nothing in these Terms affects mandatory consumer protection rights you have under the laws of your place of residence.
